Terms of Service
Last updated: 28 October 2026
These terms govern your use of HermesSync. By installing the app on your Shopify store you accept them. If you do not accept them, do not install the app.
1. Who we are
HermesSync is operated by IPAG Ltd, a company registered in England and Wales. In these terms, "we", "us" and "our" mean IPAG Ltd, and "you" means the merchant who installs or uses the app. "The app" means HermesSync, including the Shopify embedded app, this website and anything we provide through them.
You can reach us at hello@hermessync.ai.
2. Who may use the app
The app is for businesses. You may use it only if you operate a Shopify store, you are at least 18, and you have authority to enter these terms on behalf of that business. Access is tied to your Shopify store, and you are responsible for everything done through your store's installation.
3. What the app does
HermesSync identifies products gaining attention, scores them by how fast that attention is moving, checks how many advertisers are currently active on them, imports product data from supported suppliers, generates product page copy and images, and publishes pages to your Shopify store.
We may change, add to or withdraw features. If we withdraw something significant from a paid plan, you may cancel under section 5.
4. No guarantee of results
This section matters more than any other, so read it carefully.
The app provides information and tools, not advice and not a prediction. Velocity scores, market phase labels such as Untapped or Saturated, advertiser counts and any other signal are estimates derived from third-party data at a point in time. They may be incomplete, delayed or wrong.
We do not promise that any product will sell, that a product labelled Untapped will be profitable, that a product labelled Saturated would not have sold, or that using the app will increase your revenue, traffic, conversion rate or search ranking. Every commercial decision you make, including what to stock, what to spend on advertising and what to publish, is yours alone.
5. Plans, billing and the free plan
The app offers a free plan and paid plans. Paid plans are billed through Shopify, in the currency Shopify bills your store in, and appear on your Shopify invoice rather than being charged by us directly. Shopify's own terms govern that payment relationship.
- The free plan requires no card and has no end date. Its allowance of page builds and image credits is granted once rather than monthly: when it is used up your account stays active and keeps what you have built, but creating new pages requires a paid plan. We may change what the free plan includes, with notice on this site or in the app.
- Paid plans include a monthly allowance of page builds and image credits. Paid allowances reset at the start of each billing cycle and unused allowance does not roll over.
- You can change or cancel your plan at any time from your Shopify admin. Cancellation takes effect at the end of the current billing period, and fees already charged for that period are not refunded unless the law requires it.
- We may change prices. Changes apply from your next billing period after we tell you.
6. Acceptable use
You agree not to:
- Resell, sublicense or share access to the app, or use one installation to serve stores you do not operate.
- Use the app for products that are unlawful to sell in your market, counterfeit, or infringe someone else's trade marks, copyright or design rights.
- Attempt to extract our data in bulk, circumvent plan limits, probe or disrupt the service, or access it other than through the interfaces we provide.
- Publish generated content that is false, misleading, or that makes claims about a product you cannot substantiate.
We may suspend or end access that breaches this section, and will tell you why.
7. Generated content, and what you are responsible for
As between you and us, you own the product pages, copy and images the app generates for your store, and you may use them commercially. We claim no ownership over your store content.
In exchange, you are responsible for what you publish. Generated text and images are drafts and must be reviewed before they go live. AI output can be inaccurate, can describe a feature a product does not have, and can produce an image that does not match the item you will actually ship. Publishing an inaccurate product page can breach consumer protection law in your market.
You are also responsible for having the rights to any image or text you import. Supplier photographs are frequently owned by someone other than the supplier, and transforming an image does not create a right to use it. We do not warrant that imported or generated material is free of third-party rights.
We may use aggregated, non-identifying usage data to improve the app. We do not use your store's customer data to train models.
8. Third-party services
The app depends on services we do not control, including Shopify and the supplier and advertising platforms we read data from. Those services can change their terms, their data or their availability at any time, which may change or interrupt parts of the app. Your use of any third-party service remains subject to that provider's own terms.
9. Availability
We aim to keep the app available but do not guarantee uninterrupted service. We may take it down for maintenance, and may release features marked beta or preview that are still changing and may be withdrawn.
10. Data protection
How we handle personal data is set out in our Privacy Policy, which forms part of these terms. Where we process personal data on your behalf, we do so as processor and you as controller.
11. Our intellectual property
We own the app, its software, interfaces, branding and the scoring methodology behind it. Nothing here transfers that to you. You get a limited, non-exclusive, non-transferable right to use the app while your installation is active and your account is in good standing.
12. Ending the agreement
You can end it at any time by uninstalling the app from your Shopify admin. Uninstalling removes our access to your store and cancels any active subscription through Shopify.
Pages you published stay in your store after you leave, because they are your Shopify products rather than ours. We may delete the data we hold about your installation after termination, as described in the Privacy Policy.
13. Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited.
Subject to that, and because the app is supplied to businesses rather than consumers:
- The app is provided as is. We exclude all warranties not expressly stated here, to the extent the law allows.
- We are not liable for lost profits, lost sales, lost or wasted advertising spend, loss of goodwill, loss of data, or any indirect or consequential loss.
- Our total liability arising out of or in connection with these terms is limited to the fees you paid us for the app in the twelve months before the claim arose, or one hundred pounds sterling if you paid nothing.
14. Indemnity
You will indemnify us against claims, losses and reasonable costs arising from products you sell, content you publish, your breach of these terms, or your infringement of someone else's rights.
15. Changes to these terms
We may update these terms. We will change the date at the top of this page, and for material changes we will give notice in the app or by email before they take effect. Continuing to use the app after that means you accept the updated terms.
16. Governing law
These terms and any dispute arising from them are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
17. General
If any part of these terms is found unenforceable, the rest continues to apply. Our not enforcing a term is not a waiver of it. You may not transfer your rights under these terms without our consent. These terms and the Privacy Policy are the whole agreement between us about the app.
